In order to explain the term “law” in simple words, from my own perspective “ Laws are the rules and regulation created by the government body and imbided on its citizens to maintain public order or public conscience “
But since we all human beings living in such diverse environment and people from different community collides together in this universe, some of the laws might differ from country to country because of different customs, traditions, beliefs and values followed all over the world for eg: In the states the legal age for using a gun is 18 and above, but from where I come from the minimum age is 21.But some laws are similar for example if it’s a murder a theft or a terrorist attack the laws are the same where the punishment is surely granted for the one who commits the crime.
From an overview we can see the importance of law as rightly said by Mr Henry Ward Beecher, “ A law is valuable, not because it’s a law, but because there’s a right in it”.
Sure if Law wouldn’t have existed we can’t be sure if mankind would have experienced the peace, justice, the basic decorum or the most important human rights that were not taken seriously back in centuries, but we can’t even deny the fact that today the situation around the world is exponential when it comes to human rights, but can we say it’s better.
So if we see silver lining in the world because of the law ! So why does this question even arise
Should the law be broken if you think the law is not justifiable for you?
As rightly said the grass always looks greener on the other side and to back this side of the question
Mahatma Gandhi has said “ when the law is unjust, It is only right to disobey” or phrased by Mr Martin Luther King “ One has a moral responsibility to disobey Unjust laws”. Law surely have positive aspects to it and it was created with a lot of efforts by the administrators to maintain peace and order of the specific country and by keeping the well being of their country in mind. But Laws are narrow, we live in a century where things, perspectives changes day by day . People’s problems their Lifestyles , their needs, their tolerance level, their sensitivity and their minds have evolved during all this year’s so it’s not acceptable or even imaginable to follow the laws, which were created some 60-70 years ago, modifications in the law is must and should be changed according to situation that arises.
But no every human being is same everyone have their own mindset and social beliefs, if one things that one thing is right for them, the other person may not thing so accordingly. Everyone have their own perception towards a situation, there where a law plays a principal role that “law sees everyone equally “ “law is backed by the power” which doesn’t sees the reason behind your actions but sees the end action that leads to disrupt of law. But there might be some laws which might come between human rights or which might not be interchange with individual rights, taking in account the recent ban on abortion in Texas which was taken by the administrative of the Texas has shook the world . Since, people look upto America as the most liberal country and many developing and underdeveloped or even developed countries for that matter follow their footsteps when it comes to a democratic country,
Dose this not question the right of a woman to take decisions regarding her own body? The ban recited that quote unquote “ women’s in Texas were not able to abort till 6 weeks of their pregnancy “but to question overe here is that at the 6 week it’s not even known that of the woman is pregnant or not and saying that it’s illegal to abort where the question arise what about the innocent baby? Who has to face the harsh reality, but at 6 th week it’s just an embroy without any body, any heart so there not a single question that raises about killing a child and in some countries there’s a complete ban on abortion, but what if it is detected that the baby will have some illness or is not going to be healthy and what if the mother has been victim of sexual abuse or rape, or if the parents are not capable or in a state to give the child a good life, some people might think that better option is to give the baby to orphanage but how much can you trust them when the baby turn into 18 he/she has to take his/her own responsibility without any dependent financial aid and most important there was line from the series harry Potter said by professor Snape to Harry that “ don’t cry over people who are dead, be sorry for people who are Living without being loved”. There a lot of cases of child and sex trafficking taking place through orphanage, but this law should be strongly enforced when it comes to issues like female foeticide and organ trafficking of babies. So there are cases where law is needed and in some places where law breaks the social norms of human rights.Another recent example is from the country Philippines where recently there was a ban on child marriage, which we all can agree was a great step towards human rights but though it was seen as a controversial law in the country some people agreeing because of basic reason such as it’s a very young age to bear childrens and take responsibility of a family and to make right decisions but some people disagreeing mostly the Islamic community as it goes against their customs and beliefs and they raised the issue and asked an exemption from this law and should be given the freedom to follow their own beliefs.
Now as we saw the above claims we can conclude that every coin has two sides for some people to rob something might be like a job Or a situation may ask for like if you want to feed your hungry siblings but the law we see as a robbery. So to conclude “ It is not wisdom but authority that makes law”- Thomas Hobbes.
